免责及诉讼弃权声明

我理解并承认，本人或被监护未成年人参加俄亥俄当代中文学校（以下简称”学校”）提供的各类课程和活动涉及一定的风险，例如身体伤害、事故、疾病和财产损失等固有风险。为获准参与这些活动，本人自愿同意承担所有风险，并免除学校、其理事会成员、校委会成员、雇员、代理人、志愿者和代表（统称“被免责方”）任何及一切法律责任、索赔、追诉或其他后果。
本人进一步知晓并同意以下内容：
1、风险承担：本人充分了解参与学校活动所涉及的风险和危险，并自愿选择参与，承担与此类参与相关的所有风险。
2、医疗授权：在参与学校活动期间发生任何伤害或疾病的情况下，我授权学校代表本人为本人或被监护人寻求医疗治疗，并同意免除被免责方对此类医疗治疗产生的任何及一切法律责任。
3、 赔偿：本人同意赔偿并保护被免责方免受任何及一切由于本人参与学校活动或违反本免责声明而产生的索赔、行动、诉讼、程序、成本、费用、损害和责任（包括律师费）。本人已经仔细阅读并完全理解本免责声明及放弃权益。本人知晓通过注册课程，本人、被监护人、本人的继承人、遗嘱执行人、管理人和受让人放弃了某些可能针对被免责方提出的法律权利。
4、摄影和宣传：本人同意学校在无需支付报酬或提前通知的情况下，在以推广和教育为目的宣传中使用本人及被监护人的肖像、姓名、声音和图像。
5、适用法律：本免责声明应依据Ohio的法律予以解释和适用，不考虑其法律冲突原则。
本人已经仔细阅读并完全理解本免责及放弃权益声明。本人知晓通过注册课程，本人、被监护人、本人的继承人、遗嘱执行人、管理人和受让人放弃了某些可能针对被免责方提出的法律权利。
如果本声明的中文版与英文版的解释有出入，以英文版为准。
Liability Waiver and Release of Claims
I hereby acknowledge and understand that my participation or minor’s participation in activities, classes, events, and any related programs offered by Ohio Contemporary Chinese School (hereinafter referred to as “the School”) involves certain inherent risks, including, but not limited to, physical injury, accidents, illness, and property damage. In consideration for being permitted to participate in these activities, I or the minor participant willingly agree to assume all risks and to release, discharge, and hold harmless the School, its directors, officers, employees, agents, volunteers, and representatives (collectively referred to as “Released Parties”) from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or the minor participant, or to any property belonging to me, whether caused by negligence or otherwise, while participating in or being present at the School’s activities.
I further understand and agree to the following:
1. Assumption of Risk: I am fully aware of the risks and hazards involved in the school’s activities and voluntarily choose to participate, assuming all risks associated with such participation.
2. Medical Authorization: In the event of any injury or illness during my participation or the minor’s participation in School activities, I authorize the school’s representatives to seek medical treatment on my or the minor participant’s behalf and agree to hold the Released Parties harmless from any and all liability arising from such medical treatment.
3. Indemnification: I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, arising out of or in connection with my participation or the minor’s participation in School activities or any breach of this waiver.
4. Photography and Publicity: I grant permission to the school to use my or the minor participant’s likeness, name, voice, and images for promotional and educational purposes without compensation or notice.
5. Governing Law: This waiver shall be governed by and construed in accordance with the laws of Ohio, without regard to its conflict of laws principles.
I HAVE CAREFULLY READ AND FULLY UNDERSTAND THIS LIABILITY WAIVER AND RELEASE OF CLAIMS. I AM AWARE THAT BY ENROLLING IN CLASS(ES) OFFERED BY OCCS, I AM (AND ON BEHALF OF THE MINOR PARTICIPANT) WAIVING CERTAIN LEGAL RIGHTS I OR THE MINOR PARTICIPANT, MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, AND ASSIGNS MAY HAVE AGAINST THE RELEASED PARTIES.
学校付款接收账号为school@occs-ohio.org，目前仅接受QuickPay和 Zelle两种付款方式。请家长在付款备注中写明学校网站的家庭账号（请确定使用Email作为OCCS网站登录账号）。如果没有以上付款方式，可以找人代付。
